Terms of Service

These Terms of Service (the "Terms") form a binding agreement between you ("you", the "Customer") and GM Sunshine LLC, doing business as SEOlvl ("SEOlvl", "we", "us"), a company organized under the laws of the State of Delaware, United States, with its registered address at 8 McCullough Dr, New Castle, DE 19720, USA. They govern your access to and use of the SEOlvl website at https://seolvl.com and all related services (the "Service").

By creating an account, submitting a domain, or otherwise using the Service, you agree to these Terms, our Privacy Policy and Acceptable Use Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind it.

1. The Service

SEOlvl provides domain authority scoring, backlink intelligence, on-page and technical SEO health auditing, monitoring, alerting and related tooling. The Authority Score and other metrics are SEOlvl's own estimates derived from public and third-party data. They are approximations provided for informational purposes only, are not endorsed by or affiliated with Ahrefs, Moz, Semrush, Google or any other party, and must not be relied upon as a guarantee of search ranking, traffic or business outcomes.

2. Accounts

You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account. Notify us promptly at [email protected] of any unauthorized use. You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service.

3. Plans, billing and renewal

• Paid plans are billed in advance on a recurring (monthly or annual) basis through our payment processor, Stripe. By subscribing you authorize recurring charges until you cancel.
• Subscriptions renew automatically at the then-current price for the same term unless cancelled before the renewal date.
• We may change pricing or plan features with reasonable prior notice; changes take effect on your next renewal.
• Fees are exclusive of taxes, which you are responsible for where applicable.
• Cancellations and refunds are governed by our Refund & Cancellation Policy.

4. Acceptable use

Your use of the Service is subject to the Acceptable Use Policy, which is incorporated into these Terms. Violations may result in suspension or termination without refund.

5. Public profiles and domain data

The Service generates publicly accessible profile pages, leaderboards and directory listings for domains. Domain-level data (such as estimated authority, public backlink information and technical signals) is derived from publicly available sources and is not personal data. If you are the owner of a domain and wish to control or remove a public profile, you may use the in-app privacy controls or contact us; see the Acceptable Use Policy for the removal process.

6. Intellectual property

The Service, including its software, design, scoring methodology and content (excluding your data), is owned by GM Sunshine LLC and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service during your subscription. You may not copy, resell, reverse-engineer, scrape, or create derivative works of the Service, or use it to build a competing product. You retain ownership of data you submit; you grant us a license to process it to provide the Service.

7. Third-party services

The Service relies on third parties (e.g. Stripe, Google PageSpeed Insights, Open PageRank/DomCop, Common Crawl, Cloudflare). We are not responsible for third-party services and their availability or terms. See our Sub-processors list.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. We do not warrant that scores, metrics, audits or alerts are accurate, complete, error-free or uninterrupted, or that they will produce any particular SEO or business result.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GM Sunshine LLC AND ITS OFFICERS, MEMBERS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 100.

10. Indemnification

You will indemnify and hold GM Sunshine LLC harmless from claims, damages and expenses (including reasonable legal fees) arising from your use of the Service, your data, or your breach of these Terms or applicable law.

11. Suspension and termination

You may stop using the Service and cancel at any time. We may suspend or terminate access if you breach these Terms or the Acceptable Use Policy, fail to pay, or where required by law. On termination your license ends; sections that by their nature should survive (e.g. IP, disclaimers, liability, indemnity, governing law) survive.

12. Changes to these Terms

We may update these Terms. Material changes will be notified by posting an updated effective date and, where appropriate, by email or in-app notice. Continued use after changes take effect constitutes acceptance.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. The state and federal courts located in Delaware will have exclusive jurisdiction, and you consent to that venue, except that either party may seek injunctive relief in any competent court.
